WORKS CLAIMS VICTORY IN FEDERAL LAWSUIT WITH CITY OF MIAMI
CocoDorm residents are here to stay in the "House
Next Door"
MIAMI (January 27, 2009) – Flava
Works Inc. announced the judgment of its pending case against
the City of Miami. In September 2007, Flava Works
filed a lawsuit disputing the city’s claims that
zoning and enforcement laws applied to the CocoDorm residence.
The city sought legal sanctions as well as imposed numerous
fines; all aimed to shut it down.
In an earlier statement James Benjamin, an attorney of Flava Works, believed
that the ruling would be made in his client’s favor. Benjamin informed
the city of a similar case in Tampa against VoyeurDorm, an adult webcam operation
practically identical to the CocoDorm. However, the ruling in VoyeurDorm’s
favor was not considered and the city continued to pursue with legal action.
Flava Works’ victory was due in large part to the city breaching various
U.S. Constitutional as well as Florida Constitutional violations of restraints.
Zoning and adult business licensing provisions the city sought to enforce did
not apply to the CocoDorm.com website. Business and licensing regulations only
apply to physical – not virtual space. The CocoDorm residence is occupied
by several of Flava Works’ models who broadcast their lives 24/7. All
business activity occurs elsewhere at the Flava Works HQ which is and always
has been licensed to operate in the City of Miami legally.
Phillip Bleicher, CEO of Flava Works, said “We have fought very hard
on this and never once did we lose faith. We’re pleased with the case’s
ruling and to know that justice has prevailed on our side.”
The City of Miami was first made aware of the CocoDorm by an anonymous packet
distributed amongst the dorm’s neighbors and to local news agencies.
Flava Works will now seek out the individuals and/or companies who sent these
packets which contained defamatory documents.
